Refund and Cancellation Policy

1. General
This policy governs the cancellation and refund rights for paid subscriptions to the FlashAI service (the "Service"), operated by East and West LTD (the "Operator"). It is drafted in accordance with the Israeli Consumer Protection Law, 5741-1981, and the Consumer Protection Regulations (Cancellation of Transactions), 5771-2010.
2. Cancellation Period (Right of Withdrawal)
A customer may cancel a purchase within 14 days of payment, provided no material use of the Service has occurred (as defined below). Cancellation requests must be submitted in writing to eastandwestltd2021@gmail.com or through the subscription management center on the site.
3. Definition of "Material Use"
For the purposes of this policy, "material use" means consumption of more than 10% of the monthly action quota included in the subscription (e.g. more than 50 generations on Pro, or more than 200 generations on Business) between payment and the cancellation request. In cases of material use, refunds will be issued pro-rata, based on consumption.
4. Cancellation Fees
In accordance with the regulations, the Operator may charge a cancellation fee equal to 5% of the transaction value or 100 NIS, whichever is lower. The fee will be deducted from the refund. The Operator may waive the cancellation fee under exceptional circumstances at its sole discretion.
5. Cancellation After 14 Days
After the 14-day window, subscriptions may be cancelled at any time via the subscription management center. Cancellation takes effect at the end of the current billing period; no pro-rata refunds are issued for the unused portion. The subscription remains active until the end of the paid period.
6. Refund Process
For approved cancellations, refunds are processed as follows:
- Refund issued to the original payment method (credit card) within 14 business days of approval;
- The refund amount is calculated based on actual amount paid, less any cancellation fee and pro-rata usage (if applicable);
- A confirmation email will be sent to the customer.
7. Cases Not Eligible for a Refund
No refund will be issued in the following cases:
- Subscription was terminated by the Operator due to a Terms of Service breach (e.g. abuse, attempted intrusion, or unauthorized commercial use);
- Free subscriptions are not eligible for refunds (no payment was made);
- Full consumption of all monthly subscription actions before the cancellation request was submitted.
8. Disputes
In the event of disagreement regarding the refund amount or the Operator's decision, you may submit a written request to the Operator's email address. The matter will be resolved according to the procedures established by law. Exclusive jurisdiction over any dispute lies with the competent courts in Tel Aviv-Yafo.
